Terms of Service

1. Purpose

These Terms of Service define the conditions under which Orkestr8 / QR Communication makes the orkestr8.io website available to users, and the conditions under which users access and use it.

Any access to the site implies unconditional acceptance of these Terms. Orkestr8 reserves the right to modify them at any time, with new terms applicable upon publication on the site.

Access to the orkestr8.io marketing website is free and open to any user with an internet connection.

Access to the app.orkestr8.io platform requires creating a user account and subscribing to one of the available pricing plans. Platform-specific terms are covered in separate General Terms of Sale (GTS), provided at registration.

Orkestr8 reserves the right to suspend or interrupt access to the site for maintenance, updates, or in cases of force majeure, without incurring any liability.

4. User Obligations

By accessing the site, the user agrees to:

• Use the site fairly, in compliance with applicable laws and regulations;
• Not attempt to decompile, disassemble, or perform any reverse engineering on the platform or its components;
• Not conduct load testing, automated scraping or computer attacks of any kind (DDoS, injection, fuzzing, etc.);
• Not infringe on the intellectual property rights of Orkestr8 or third parties;
• Not transmit unlawful, offensive, defamatory or privacy-violating content;
• Immediately inform Orkestr8 of any security vulnerability or unauthorized use of the site they become aware of.

Any breach of these obligations may result in immediate termination of access to the service and legal proceedings.

5. Intellectual Property

All elements of the orkestr8.io website (texts, images, logos, visuals, structure, graphic charter) are protected by French intellectual property law and are the exclusive property of Orkestr8 / QR Communication.

Any reproduction, even partial, is strictly prohibited without prior written authorization from Orkestr8 / QR Communication.

The Orkestr8 platform is a proprietary SaaS service. Any reproduction, reverse engineering or attempt to extract the source code is strictly prohibited. Brand elements, logos and editorial content are the exclusive property of Orkestr8 / QR Communication.

6. Personal Data

The processing of personal data collected when using the site is governed by our Privacy Policy, available on this site, and complies with the GDPR (EU Regulation 2016/679) and applicable data protection legislation.

7. Limitation of Liability

Orkestr8 / QR Communication shall not be held liable for:

• Service interruptions due to maintenance operations, network outages, hosting provider incidents or any force majeure event;
• Direct or indirect damages resulting from the use or inability to use the site;
• Content and practices of third-party sites accessible via hyperlinks on the site;
• Errors or omissions in the information provided on the site.

The site is provided "as is" without any express or implied warranty of continuous availability (100% uptime is not guaranteed). Orkestr8's liability shall in no case exceed the amounts paid by the user under their subscription over the past 12 months.

The orkestr8.io site may contain links to third-party websites. Orkestr8 / QR Communication exercises no control over these sites, their content or their data protection practices, and accepts no liability for any damages that may result from consulting them.

Third parties are permitted to create links to orkestr8.io, provided such links do not damage the Orkestr8 brand image and the link is clearly identified as pointing to orkestr8.io.

9. Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute regarding their interpretation or execution, the parties will endeavor to find an amicable solution.

Failing an amicable agreement, the dispute shall be submitted to the exclusive jurisdiction of the Paris Commercial Court.

10. Modifications to the Terms

Orkestr8 / QR Communication reserves the right to modify these Terms at any time. Users will be notified of substantial changes via a visible notification on the site. The date of the last update is indicated at the top of this page.

Continued use of the site following notification of changes constitutes acceptance of the new terms.
